A. Terms and Conditions for Hub of Wellness
Introduction
Welcome to Hub of Wellness (“Platform”). These Terms and Conditions (“Terms”) govern your access to and use of the Hub of Wellness website and mobile application, which connect users (“Users,” “You”) with third-party wellness practitioners and service providers (“Providers”). By accessing, registering, or using the Platform, you agree to comply with and be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Platform. Continued use constitutes acceptance of any revisions.1. Platform Services and Scope
Intermediary Role: The Platform functions solely as an intermediary under the Information Technology Act, 2000, facilitating connections between Users and independent Providers. Hub of Wellness does not employ, endorse, guarantee, or control the Providers or the quality, safety, legality, or efficacy of their services or products. We conduct basic verification but do not guarantee the qualifications, credentials, or licenses of Providers. Users are encouraged to conduct their own due diligence. No Medical Advice: Services and information provided on the Platform, including those offered by Providers (e.g., holistic therapies, coaching, alternative practices), are for informational and general wellness purposes only. They do not constitute medical advice, diagnosis, or treatment. Always consult a qualified and licensed healthcare professional for any health concerns or before making any decisions related to your health or treatment.2. User Obligations and Conduct
Eligibility: You must be at least 18 years old and capable of forming a binding contract to use the Platform. If minors access the platform, it must be under the direct supervision and consent of a parent or legal guardian who agrees to these Terms on their behalf. Account Registration and Security: You agree to provide accurate, current, and complete information during registration and maintain the security of your account credentials. You are responsible for all activities under your account. Notify us immediately of any unauthorized use. Lawful Use: You agree to use the Platform only for lawful purposes and in compliance with all applicable laws and regulations, including the Information Technology Act, 2000 and its rules. Prohibited Conduct: You shall not:- Engage in harassment, abuse, stalking, discrimination, or any unlawful activities.
- Upload, post, or transmit content that is defamatory, obscene, pornographic, infringing, harmful, or otherwise objectionable.
- Impersonate any person or entity or misrepresent your affiliation.
- Violate the intellectual property rights of Hub of Wellness or any third party.
- Share login credentials, attempt unauthorized access, or disrupt the Platform’s security or functionality.
- Circumvent payment systems or engage in fraudulent transactions.
- Use the Platform to distribute spam or unsolicited messages.
- Collect or store personal data about other users without explicit consent and in violation of applicable data privacy laws.
3. Data Privacy and Consent (Compliance with DPDP Act, 2023)
Privacy Policy: Your use of the Platform is also governed by our Privacy Policy, which details how we collect, use, process, store, and protect your personal data. Consent: By using the Platform, you consent to the collection, processing, and use of your personal data as described. Where specific consent is required under the DPDP Act, we will obtain your explicit, informed, and withdrawable consent. Data Subject Rights: You have rights under the DPDP Act including the right to access, correct, update, and request erasure of your data, and withdraw consent. Data Security: Hub of Wellness implements reasonable security practices to protect your data. However, no system is completely secure. Data Breach Notification: In the event of a significant personal data breach, we will notify affected individuals and the Data Protection Board of India as required. Provider Data Handling: Providers are independent data fiduciaries. Hub of Wellness is not responsible for their individual data handling practices outside our processing scope.4. Disclaimers of Liability and Warranty
Intermediary Liability Limitation: As an intermediary, our liability is limited under Section 79 of the IT Act, 2000. Services and Products: We act solely as a facilitator. We disclaim any warranties, express or implied, regarding services or products offered through the Platform. Resolution of Disputes: Any issues or claims must be resolved directly between Users and Providers. Hub of Wellness is not liable for any related damages or dissatisfaction. Platform “As Is”: The Platform is provided without warranties. We do not guarantee uninterrupted or error-free access. Third-Party Content and Links: Hub of Wellness is not responsible for content or links from third parties. Report any concerns to us.5. Booking, Payments, and Cancellations
Appointments: Booking details, including fees, are determined by Providers. Cancellation Policy: Users must adhere to the cancellation policy at the time of booking. Late cancellations or no-shows may incur charges. Payment Processing: Payments are handled via secure third-party gateways. We are not responsible for payment errors unless directly caused by our negligence.6. Intellectual Property
Platform Ownership: All content, trademarks, and software are owned by or licensed to Hub of Wellness. Unauthorized use is prohibited. User Content: By submitting content, you grant us a license to use it in connection with the Platform. You must have rights to grant this license.7. 8. Dispute Resolution and Governing Law

Introduction
Welcome to Hub of Wellness (“Platform”). These Terms and Conditions (“Terms”) govern your registration and participation as a healer, therapist, or wellness practitioner (“Practitioner,” “You”) on the Platform, which connects Practitioners with clients (“Clients” or “Users”) seeking holistic services and wellness products. By registering and using the Platform, you agree to abide by these comprehensive Terms and our General Terms of Service and Privacy Policy. Failure to comply may result in suspension or termination of your membership.1. Practitioner Eligibility, Verification, and Responsibilities
- Qualifications & Verification: You represent and warrant that you possess the valid and current certifications, licenses, credentials, and qualifications required by law and professional standards for the specific modalities you offer. Misrepresentation is grounds for immediate termination.
- Ethical Standards: You must adhere to the highest professional and ethical standards, maintaining honesty, integrity, and professional boundaries.
- Service Delivery: Deliver services professionally as described in your profile. Clearly communicate any changes to Clients in advance.
- Platform Integrity: Uphold the reputation of Hub of Wellness. Detrimental actions may result in termination.
- Compliance with Laws: You are responsible for complying with all applicable laws in India, including licensing and advertising standards.
2. Sale of Products Through the Platform
- Product Listings & Compliance: Listings must be truthful and comply with Indian laws and safety standards.
- Product Quality & Safety: You are responsible for the safety and efficacy of your products.
- Customer Support & Disputes: Handle all product-related queries and disputes directly with Clients.
- Returns & Refunds: Display a fair return/refund policy and honor it.
- Product Liability: You are fully liable for any harm caused by your products.
3. Platform Fees, Payments, and Taxes
- Service Fee: A 30% service fee is charged on all transactions through the Platform. Subject to change with notice.
- Payment Processing: Payments are made via the Platformâs gateway. Disbursement schedule will be specified separately.
- Taxes: You are responsible for your tax obligations, including GST and income tax. Provide necessary details for compliance.
4. Data Protection and Confidentiality (DPDP Act, 2023)
- Practitioner as Data Fiduciary: You must comply with all DPDP Act obligations when processing Client data.
- Compliance Obligations:
- Process data lawfully and fairly.
- Obtain informed consent for data use.
- Ensure accuracy and implement security safeguards.
- Respect data access, correction, erasure, and consent withdrawal rights.
- Notify in case of data breaches.
- Platform as Data Processor: Hub of Wellness acts as a processor only for data used to facilitate bookings and payments.
- No Unauthorized Disclosure: Do not share Client data without explicit consent, unless required by law.
5. Prohibited Conduct
- Engaging in illegal or unethical practices.
- False claims about services, products, or credentials.
- Selling unsafe or counterfeit products.
- Misusing communication tools or Client information.
- Soliciting off-platform transactions.
- Sharing personal contact info unless permitted.
- Uploading malicious software.
6. Complaints, Suspension, and Termination
- Complaints Handling: Complaints may result in investigations and temporary suspension. You must cooperate fully.
- Grounds for Immediate Termination: Including misrepresentation, unsafe products, data breaches, and unethical behavior.
- Consequences: Terminated Practitioners may be blacklisted and forfeit pending payments.
7. Liability Disclaimer and Indemnification
- Platform Role: Hub of Wellness only connects Practitioners and Clients.
- Disclaimer: We are not liable for service or product issues.
- Practitioner Liability: You are responsible for any harm from your services/products.
- Indemnification: You agree to indemnify Hub of Wellness against any related claims or legal actions.
8. Dispute Resolution
- Client Disputes: Must be handled directly and professionally by you. Hub of Wellness may mediate at its discretion.
- Disputes with Hub of Wellness: Resolved through arbitration by the Delhi International Arbitration Centre in New Delhi.
9. Amendments and Governing Law
- Amendments: We may modify these Terms with at least 15 daysâ notice for significant changes.
- Governing Law: These Terms are governed by Indian law.
10. Acknowledgment
By registering and using the Hub of Wellness Platform, you acknowledge that you have read, understood, and agree to these Terms and Conditions. You commit to upholding professionalism, ethics, and legal compliance in all activities on the Platform.C. Terms and Conditions for Clients on Hub of Wellness
1. Eligibility and Registration
- Age Requirement: You must be at least 18 years old to register and book services independently on the Platform. Minors (under 18) may only access services under the direct supervision and with the explicit consent of a parent or legal guardian who agrees to these Terms on the minor’s behalf and assumes responsibility for their use of the Platform.
- Registration Information: You agree to provide accurate, current, and complete information during the registration process. This may include basic contact details and relevant health history or consent forms required by the specific Practitioner. Providing false information may result in suspension or termination of your access.
- Account Security: You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account.
2. Nature of Services and Health Disclosure
- Non-Medical Services: You understand that the therapies and services offered by Practitioners (e.g., Reiki, coaching, yoga, alternative therapies) are generally considered complementary or alternative wellness services. They are NOT substitutes for professional medical diagnosis, treatment, or advice. Hub of Wellness does not offer medical services.
- Consult Healthcare Providers: Always consult a licensed physician for any medical or mental health concerns. Do not delay seeking medical advice because of services received through this Platform.
- Health Disclosure Responsibility: You are responsible for disclosing any pre-existing conditions, allergies, medications, or relevant health info to the Practitioner before your session. This ensures your safety and the effectiveness of the service.
3. Booking, Payment, and Fees
- Booking: Services are booked directly with Practitioners via the Platform.
- Advance Payment: Payment is required at booking using the Platformâs secure gateway unless otherwise noted.
- Non-Refundable Fees: Payments are generally non-refundable unless stated in the cancellation policy or as required by law.
4. Cancellations, Rescheduling, and No-Shows
- Client Cancellation/Reschedule: Provide at least 24 hours’ notice (or the timeframe set by the Practitioner) to cancel or reschedule without penalty.
- Late Cancellations/No-Shows: Cancelling late or missing a session will forfeit the full session fee.
- Exceptional Circumstances: Refunds or rescheduling for emergencies are at the Practitionerâs discretion. Supporting documentation may be required.
- Practitioner Cancellations: If a Practitioner cancels, you are entitled to a refund or reschedule via the Platform.
5. Platform Role and Liability Disclaimer
- Intermediary Role: Hub of Wellness acts only as a platform connecting Clients and Practitioners. We do not offer wellness services ourselves.
- No Endorsement or Guarantee: Practitioners are independent. Hub of Wellness does not guarantee their skills, safety, or service outcomes.
- Disclaimer of Liability: We are not liable for any injury, dissatisfaction, or damages related to Practitioner services. All service issues should be resolved directly with the Practitioner.
6. Confidentiality and Data Protection (DPDP Act, 2023)
- Our Commitment: We protect your data under Indiaâs Digital Personal Data Protection Act, 2023 (DPDP Act). See our Privacy Policy for details.
- Practitioner Confidentiality: Practitioners must also maintain confidentiality as Data Fiduciaries under the DPDP Act.
- Data Usage & Consent: By using the Platform, you consent to our processing of your data to facilitate sessions and operations. Practitioners collect only whatâs needed for their service.
- Limitations: Confidentiality may be waived where legally required (e.g., mandatory reporting).
7. Client Code of Conduct
- Respectful Behaviour: Treat Practitioners and users with respect at all times.
- Prohibited Conduct: Harassment, abuse, discrimination, or illegal activity is not tolerated.
- Consequences: Violations may result in session termination without refund and account suspension.
8. Complaints and Disputes
- Practitioner Complaints: Report concerns to Hub of Wellness support within 7 days of the session, with details for investigation.
- Dispute Resolution: We may mediate disputes at our discretion but are not obligated to. Final responsibility lies with the Client and Practitioner.
- Platform Disputes: Contact our Grievance Officer for any issues related directly to the Platform’s functioning.
9. Changes to Services and Policies
We may modify services, Terms, or fees. Reasonable notice will be provided via email or Platform notifications. Continued use constitutes acceptance.10. Governing Law and Jurisdiction
These Terms are governed by Indian law. Disputes shall fall under the jurisdiction of the courts in New Delhi, India.Acknowledgment
By registering, booking, or using services on Hub of Wellness, you acknowledge and agree to these Terms and our Privacy Policy. You agree to act in good faith while using the Platform.D. Terms and Conditions for Training Sessions of Hub of Wellness
1. Eligibility and Registration
- Age Requirement: You must be at least 18 years old to enrol in and participate in training sessions offered via the Platform.
- Registration: You must complete the Platform registration process and the specific training session registration, providing accurate, current, and complete personal information. Acceptance into a session may be subject to prerequisites defined by the Trainer.
2. Training Content, Delivery, and Certification
- Course Description: Training sessions provide foundational and/or advanced knowledge in the selected subject, as listed by the Trainer.
- Trainer Responsibility: Trainers are solely responsible for content, quality, and delivery. Hub of Wellness does not control the content.
- Pre-Course Materials: You must review any pre-course materials provided before attending the session.
- Certification:
- Certificates are issued solely by the Trainer upon completion of all course requirements.
- Trainers may withhold certification if standards are not met.
- Certification does not guarantee legal licensure to practice.
3. Payment, Fees, and Refunds
- Payment: Full payment must be made at booking through the Platformâs secure gateway, unless otherwise noted.
- Non-Refundable Fees: Payments are non-refundable unless specified or required by law.
- Additional Fees: Extra costs may apply for reassessments, materials, or certifications, as outlined by the Trainer.
4. Cancellations and Rescheduling
- Participant Cancellation: Provide at least 7 daysâ notice (or timeframe stated by the Trainer) to cancel or reschedule.
- Late Cancellations/No-Shows: Will result in forfeiture of the full fee.
- Exceptional Circumstances: Requests due to emergencies may be considered at the Trainer’s or Platform’s discretion.
- Trainer Cancellations: Full refund or rescheduling will be offered.
5. Platform Role and Liability Disclaimer
- Intermediary Role: Hub of Wellness facilitates connections and bookings only.
- No Endorsement: Hub of Wellness does not guarantee or endorse Trainers or their sessions.
- Disclaimer of Liability: Hub of Wellness is not liable for dissatisfaction, injury, or outcomes. All disputes must be resolved with the Trainer. Liability is limited as per the Information Technology Act, 2000.
6. Participant Responsibilities and Conduct
- Punctuality and Engagement: Arrive on time, dress appropriately, and participate fully.
- Health Disclosure: Disclose any health conditions before booking or starting the course.
- Ethical Conduct: Professional and respectful behaviour is expected. Violations may lead to removal without refund.
7. Confidentiality, Data Protection, and Intellectual Property
- Confidentiality: Respect and protect information shared by other participants.
- Data Protection (DPDP Act, 2023):
- Hub of Wellness processes data in compliance with the DPDP Act and our Privacy Policy
- Trainers are separate Data Fiduciaries responsible for any personal data they collect.
- Intellectual Property: All course materials are proprietary. You may not copy, distribute, or share without written permission.
8. Complaints and Disputes
- Complaints about Training: Attempt to resolve directly with the Trainer first. Unresolved issues can be reported to Hub of Wellness support within 7 days of course completion.
- Platform Role: Hub of Wellness may investigate but is not obligated to mediate. Trainers are responsible for their own sessions.
- Platform Disputes: Contact the Grievance Officer for issues related to Platform functionality.
